1. Acceptance of these terms
These Terms of Service ("Terms") govern your use of firstprinciplesconsulting.com (the "Site"), operated by First Principles Consulting Pty Ltd (ABN 50 648 698 766, "FPC", "we", "us", "our"). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
2. About FPC
FPC is a mining operations consultancy based in Maroochydore, Queensland, Australia. The Site describes our services (including Operational Clarity and the Multiplier Method), our book Mining for Value, and provides a self-assessment tool, the Operational Score.
3. Using the Site
You may use the Site for lawful purposes only. You must not:
- Attempt to gain unauthorised access to the Site or its systems
- Use the Site to transmit malicious code or interfere with its operation
- Scrape, copy or republish Site content without our permission
- Use the Site in any way that breaches applicable law
4. The Operational Score and other tools
Any survey, self-assessment or scoring tool on the Site (including the Operational Score) provides general, indicative results based on the information you provide. It is not professional advice, and results should not be relied on as a substitute for a proper assessment of your operation. We recommend discussing your results with us before acting on them.
5. Intellectual property
All content on the Site — including text, graphics, logos, the Iceberg, Capability Curve and Performance Quadrant frameworks, and the Operational Score methodology — is owned by FPC or used under licence, and is protected by copyright and other intellectual property laws. You may view and download content for personal, non-commercial reference only. You must not reproduce, distribute or create derivative works from our content without our written permission.
6. Accuracy of information
We take care to keep the Site accurate and up to date, but we don’t guarantee all content is free of errors or omissions. Information on the Site is general in nature and doesn’t take into account your specific circumstances.
7. Third-party links and services
The Site may link to third-party websites or use third-party services (such as Tally, Coda and Webflow) to deliver certain features. We aren’t responsible for the content, accuracy or practices of third-party sites or services.
8. Limitation of liability
To the maximum extent permitted by law, FPC excludes all liability for any loss or damage arising from your use of the Site, including indirect or consequential loss. Nothing in these Terms excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Indemnity
You agree to indemnify FPC against any claim, loss or damage arising from your misuse of the Site or breach of these Terms.
10. Governing law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Queensland.
11. Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they were last revised. Continued use of the Site after changes means you accept the update.
